Privacy Notice Regarding the Personal Data Protection Law

The Medellín Museum of Modern Art Corporation (hereinafter “THE MUSEUM”), a non-profit entity established by Resolution No. 23495 of November 17, 1978, of the Government of Antioquia, registered with the Medellín Chamber of Commerce for Antioquia on February 5, 1997, in Book 1, under number 0686, and identified by Tax Identification Number (NIT) 890.984.010-5, in compliance with Statutory Law 1581 of 2012 and Decree 1377 of 2013, hereby informs its users, clients, suppliers, contractors, employees, and the general public, as Data Subjects, that their Personal Data is included and/or will be included in THE MUSEUM’s databases, and that this data has been and/or will be collected for the development of various procedures in furtherance of its corporate purpose, as follows:

1. The use and handling of Personal Data that is included or will be included in THE MUSEUM’s databases is carried out under strict standards of responsibility and integrity.

2. Personal data such as: first and last names, identification number, gender, date of birth, residential address, telephone and mobile phone numbers, email address, employment information, family information, and academic background information of users, clients, suppliers, contractors, employees, and the general public of THE MUSEUM, are used for the fulfillment of its corporate purpose and specifically for:

• Confirming its sociocultural commitment, establishing a bridge between the public, societal issues, and artistic expressions.

• Serving as a center for generating experiences, ideas, education, training, and debate around contemporary artistic practices; visual arts, architecture, urban planning, design, film, video, music, literature, reading and writing, theater, dance, television, environment, photography, gastronomy, geography, internet, new media and technology.

To be a living museum, a center for contemporary arts.

• To conserve, document, research, and exhibit the works in the museum’s collection.

• To promote activities related to contemporary artistic expression.

• To design and manage non-formal education programs for diverse audiences.

• To design and implement a pedagogical and didactic policy for the museum.

• To promote cultural entrepreneurship.

• To foster and promote emerging national and international artists through exhibitions, seminars, conferences, publications, and other activities.

• To promote the cultural exchange of individuals, institutions, services, and ideas.

• To coordinate activities with local, national, and international institutions, artists, and cities.

• To conserve and care for animal and plant species that may be visited by the public as part of an art exhibition.

• To exhibit film, performance art, live art, contact improvisation, site-specific interventions, and architectural interventions.

• To contribute to the social and cultural transformation of the city, the country, and the world.

• To support the promotion of tourism in the city of Medellín.

• To enter into agreements with public entities to receive and manage resources for the construction of artistic and cultural venues, as well as to promote events aligned with the Museum’s mission.

• To achieve the aforementioned objectives either directly or in partnership with other public or private entities or institutions that carry out similar or complementary programs.

To execute all acts and contracts directly related to the purpose of THE MUSEUM and those intended to generate income and exercise the rights or fulfill the legal or contractual obligations arising from the existence and activity of THE MUSEUM.

• To market works of art, operate real estate directly or through third parties, and generally carry out activities that allow it to generate income.

• To verify data through consultation of public databases or credit bureaus.

• To comply with legal reporting obligations to administrative bodies, as well as to the competent authorities that so require.

• To share information with third parties who collaborate with THE MUSEUM and who, for the performance of their duties, must access the information to some extent.

• To support THE MUSEUM’s audit processes.

• To conduct satisfaction surveys.

• Any other purpose that may arise in the course of the contract or the commercial relationship between THE MUSEUM and the Data Subject.

3. The mechanisms used to store this data are secure and guarantee its confidentiality, as appropriate technological means are in place to prevent unauthorized access by third parties.

4. Data subjects whose personal information is included in databases have the following rights regarding its processing: (i) To know, update, and rectify the information collected; (ii) To request, at any time, that their information be rectified, modified, updated, or deleted; (iii) To request proof of the authorization issued by the data subject, except as provided in Law 1581 of 2012; (iv) To be informed, upon request, regarding the uses applied to their personal data; (v) In compliance with legal requirements, to file complaints with the Superintendency of Industry and Commerce for violations in accordance with the provisions of Law 1581 of 2012 and other regulations that modify, add to, or complement it. (vi) Revoke authorization and/or request the deletion and processing of data in cases of violation of constitutional and legal rights and guarantees; (vii) Access their disclosed personal data free of charge; and (viii) Demand confidentiality and privacy regarding the information provided.

6. All data subjects whose information will be registered in THE MUSEUM’s databases are kindly requested to authorize the processing of their personal data, which will be provided and incorporated into databases and/or physical and/or electronic documents of all kinds held by THE MUSEUM.

7. Remember that as the data subject, you have the right at any time to access, know, update, or request the deletion or correction of your personal data.
